Welcome to MakeThis! These Terms of Service ("Terms") govern your use of the MakeThis mobile application ("App," "Service," or "we"). By downloading, installing, or using MakeThis, you agree to be bound by these Terms.

            Summary: MakeThis is a recipe discovery app. Use it responsibly, respect the content, and understand that subscriptions auto-renew unless cancelled.
        

1. Acceptance of Terms

By accessing or using MakeThis, you confirm that:

You are at least 13 years of age
You have the legal capacity to enter into these Terms
You agree to comply with these Terms and all applicable laws

If you do not agree to these Terms, do not use the App.

2. Description of Service

MakeThis provides:

Recipe discovery through swipe-based browsing
Recipe "battle" mode for decision-making
Recipe search and filtering
Favorites/cookbook management
Nutrition tracking
Multi-language recipe translation

Recipe content is sourced from Spoonacular API and other third-party providers.

3. User Accounts

MakeThis does not require account registration. Your data (favorites, preferences, nutrition logs) is stored locally on your device. If you subscribe to MakeThis Pro, your subscription is managed through your Apple ID or Google Account.

4. Subscriptions and Payments

4.1 MakeThis Pro Subscription

MakeThis offers an optional premium subscription ("MakeThis Pro") that provides:

Ad-free experience
All premium features
Priority support

4.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store
Prices are displayed in your local currency before purchase
Payment is charged to your Apple ID or Google Account upon confirmation

4.3 Auto-Renewal

Important: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellation

You can cancel your subscription at any time:

iOS: Settings → Apple ID → Subscriptions → MakeThis → Cancel
Android: Play Store → Menu → Subscriptions → MakeThis → Cancel

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

4.5 Refunds

Refund requests must be submitted to Apple or Google, as they process all payments:

5. Acceptable Use

You agree NOT to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or hack the App
Scrape, copy, or redistribute recipe content for commercial purposes
Interfere with or disrupt the App's servers or networks
Use automated systems or bots to access the App
Circumvent advertising or subscription systems

6. Intellectual Property

6.1 App Content

The MakeThis app, including its design, code, and original content, is owned by us and protected by copyright and other intellectual property laws.

6.2 Recipe Content

Recipe content, images, and nutritional information are provided by Spoonacular and other third-party sources. We do not claim ownership of this content. Use of recipes is for personal, non-commercial purposes only.

6.3 Your Content

You retain ownership of any personal data you create (favorites lists, nutrition logs, preferences).

7. Disclaimers

Health Disclaimer: MakeThis provides nutritional information for informational purposes only. We are not medical professionals. Consult a healthcare provider before making dietary changes, especially if you have allergies, medical conditions, or are pregnant.

7.1 "As Is" Service

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Accuracy of recipe content or nutritional information
Fitness for a particular purpose
Uninterrupted or error-free operation
Compatibility with all devices

7.2 Third-Party Content

We do not control and are not responsible for third-party content, including recipes from Spoonacular. Recipe accuracy, allergen information, and cooking instructions should be verified independently.

8. Limitation of Liability

To the maximum extent permitted by law:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
We are not liable for any adverse health effects resulting from following recipes or nutritional advice in the App

9. Indemnification

You agree to indemnify and hold harmless MakeThis, its developers, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be notified through the App or by updating the "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU users, mandatory consumer protection laws of your country of residence apply.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Informal Resolution: Contact us first at support@makethis.app
Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

            EU Users: Nothing in these Terms affects your statutory rights as a consumer under EU law. You may bring proceedings in your country of residence.
        

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
